See what rights and obligations tenants have according to the New Civil Code04 - 01 - 2012

The number of tenants increases, given that less and less Romanians can afford to buy a house. Tenants have few rights and many obligations.
According to the new Civil Code, renting a house is made on maximum 49 years, and tenants are required to pay some reparations from their own pockets.

Common use
New Civil Code provides that in buildings with multiple apartments, tenants have the right to use common parts and facilities of the building (garbage chute, dryer, lighting of common parts, etc.). At the end of the lease period, the former tenant has preferential right to conclude the new contract. On the other hand, if he is unable to use the residence by the fault of the owner, the tenant may request reduction of the rent according to the period in which he didn’t lived in the rented space.

Rent in advance
The lessee is obliged to pay rent, as follows:
- In advance, if the lease is for a month;
- The first working day of each month for up to one year contracts;
- The first working day of each quarter, the leases for over a year.

The lessee is obliged to contribute to the payment of expenses of common parts and installations. Also, the tenant must pay the costs of current repairs, maintenance of the rented house. On the other hand, if he wants to leave the house, the tenant must notify the owner 60 days before his intention.
